Rajan Gupta, J (Oral) This is a petition under Section 439 Cr.P.C. seeking regular bail in a case registered under Sections 15/61/85 of NDPS Act vide FIR No. 04 dated 14.1.2014 at Police Station Sadar Abohar, District Fazilka. Learned counsel for the petitioner submits that quantity of contraband recovered from the petitioner is 30 kg of poppy husk, which is non-commercial in nature. Petitioner is in custody since 14.1.2015. Learned State counsel has opposed the prayer. He, however, submits that petitioner is not involved in any other case under the Act. Keeping in view the aforesaid period of incarceration of the petitioner and the fact that quantity recovered from the petitioner is noncommercial in nature, he is directed to be enlarged on bail to the satisfication of trial court.
