----- AMOL RATTAN SINGH, JUDGE (ORAL) This petition has been filed under Section 439 Cr.P.C., for grant of 'regular bail' to the petitioner, in case FIR No.31 dated 04.05.2015, registered at Police Station Nurmahal, District Jalandhar, for the alleged commission of an offence punishable under Section 22 of NDPS Act. Learned counsel for the petitioner submits that the petitioner having been in custody for the past more than 09 months, after he surrendered upon his interim bail being cancelled, he deserves the concession of bail, the trial being no where near conclusion. Learned State counsel does not refute the aforesaid facts and upon query submits that out of 11 witnesses only 01 has been examined so far.
As per the custody certificate produced in Court today, the petitioner is in custody for 9 months and 11 days and there is no other criminal case seen to be registered against him. In the aforesaid circumstances, without making any comment on the actual merits of the case for or against the petitioner, it is considered Rajneesh Sharma 2017.05.16 17:50 I attest to the accuracy and authenticity of this document
