******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in complaint case No. 27/2/13 dated 28.04.2010 titled as Sukhwinder Thappar Vs. Kapil Takiyar filed under Section 138 of the Negotiable Instruments Act, pending before the Court of learned JMIC, Phillaur. Heard.
Learned counsel for the complainant submits that the matter has since been amicably settled and under the terms of settlement, petitioner has agreed to pay the cheque amount to the complainant. In view of submission made by counsel for the complainant but without expressing any opinion on the merits of the case, this petition is allowed and the order dated 01.05.2017 is made absolute subject to the condition that petitioner shall appear before the trial Court on each and every date of hearing. In the event of his non-appearance on any date without permission, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and take the petitioner into custody.
