Prayer in the instant petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in FIR No. 125 dated 27.11.2014 registered under Sections 406/498-A of the Indian Penal Code at Police Station Women Cell, Ludhiana.
Marriage of petitioner with complainant/respondent No. 2Manjit Kaur was solemnized about 91⁄2 years before filing of FIR and there was no issue from the wedlock. There are allegations of constant harassment for not bearing the child and for not meeting the demands of more dowry. It is also stated that the petitioner was having extra marital affair.
I have heard learned counsel for the petitioner and learned State counsel assisted by learned counsel for complainant-respondent No. 2.

CRM-M-1456-2015 -2When the matter was listed first time on 15.01.2015, it was submitted that petitioner was ready for reconciliation and make effort to resume cohabitation. The matter was referred to the Mediation and Conciliation Centre of this Court but the mediation proceedings have failed apparently due to non-cooperative attitude of the petitioner. The fact of matter, however, is that the interim directions were issued by this Court on 15.01.2015 but it has not been informed as to what positive steps were taken by the petitioner for an amicable settlement. The plight of a lady who has been turned out of the matrimonial home in the aforesaid circumstances has to be viewed seriously.
Learned counsel for the petitioner submits that still more efforts can be made for an amicable settlement but I do not find any force in the above contention as no headway has been made in the matter despite the FIR being registered on 27.11.2014. It is pertinent to mention that the FIR was registered after thorough enquiry of the complaint dated 26.05.2014 made to the police.
In view of the above, there is no merit in the instant petition and the same is dismissed.
