Faced with the aforestated position, learned counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to pursue the afresh application for parole which is still pending. In view of the aforestated submission, the instant petition is dismissed as withdrawn with liberty aforesaid. The State is however, directed to consider the fresh application for grant of parole expeditiously and in accordance with law and without being influenced by the factum of previous rejection.
