**** RITU BAHRI , J. (Oral) Petitioner is seeking writ in the nature of mandamus for issuance of direction to respondent No. 1 to promote him to the post of Deputy Director from the post of Resident Audit Officer, keeping in view instructions dated 11.09.2016, as the post is lying vacant since 01.01.2018. As per instructions, if vacant posts are available for promotion, it shall be finalised within a period of three months.

Learned counsel submits that his case for promotion was recommended by respondent No. 2 to respondent No. 1 but no action has been taken till date.

Without expressing any opinion on the merits of the case and keeping in view the above facts, this petition is being disposed of by giving a direction to respondent No. 1 to consider the case of the petitioner for promotion, keeping in view instructions dated 11.09.2016, in accordance with law.
