CRM-M-14636 of 2015 Petitioner seeks pre-arrest bail in FIR No. 29 dated 15.3.2015 under Section 420 IPC registered at Police Station City District Hoshiarpur.

In compliance of the order dated 31.8.2015 passed by this Court, affidavit dated 11.9.2015 of the investigating officer, filed in the Court today, is taken on record and copy thereof has been supplied to the learned counsel for the petitioner.

CRM-M-14636 of 2015 (O&M) Learned counsel for the State, on instructions from ASI Jagdeep Singh, submits that in compliance of the orders passed by this Court, petitioner has joined the investigation on more than one occasions and he is not required for the purpose of any further investigation.

However, learned counsel for the complainant submits that total amount has not been paid to the complainant by the petitioner so far. In this view of the matter, present petition is liable to be dismissed. He prays for dismissal of the present petition. Be that as it may and without commenting anything on the merits of the case, including the right of the complainant to recover the remaining amount from the petitioner, if any, instant petition is allowed. Order dated 19.5.2015 passed by this Court is hereby made absolute, however, subject to the conditions envisaged under Section 438 (2) Cr.P.C.

Disposed of, accordingly.
