Prayer made in the present petition is for directing the respondent No.2 to release the arrears of regular pay scale w.e.f. 31.07.1984 to 02.04.1991 as was paid to counterparts of the petitioner. 2.

Learned State counsel makes a reference to para 6 of the written statement filed by the respondent dated 12.01.2004, specifically stating therein that all the employees, who were reinstated by the Labour Court, Bathinda, were also paid arrears of back wages on daily wage rates as was given to the petitioner. The petitioner was appointed as washer boy on daily wage basis and reinstated on the same terms with no direction for payment of regular pay scale. Even in the previous writ petition, it was never prayed that back wages be granted in a pay scale.

To the aforesaid, there was no rebuttal by filing any replication. 4.

Disposed of, reserving the liberty to the petitioner to get it revived, in case need arises.
