Ms. Tanya Kanwer, Advocate for respondent No.2. ***** ARUN MONGA, J. (ORAL) The instant petition has been filed under Section 482 of Code of Criminal Procedure, 1973 (for short 'Cr. P.C.') seeking quashing of FIR No.455 dated 07.09.2022, registered under Section 174-A of the Indian Penal Code, 1860 (for short 'IPC'), at Police Station Sirsa Sadar, District Sirsa along with all consequential proceedings including impugned order dated 28.04.2022 (Annexure P-3) passed by learned Judicial Magistrate First Class, Sirsa declaring petitioner as proclaimed person in a criminal complaint No.NACT-1001-2020 dated 09.09.2020 titled as "Surjeet Singh Vs. Mannat Rani", under Section 138 of the Negotiable Instruments Act, 1881.

Both learned counsels are ad idem that compromise has been arrived between the parties. The amount payable to the complainant, which eventually resulted in registration of FIR in question, also stands fully paid to the satisfaction of the complainant. They further submit that even the complaint filed by the MAHAVIR SINGH 2023.07.05 10:21 I attest to the accuracy and authenticity of this order/ judgment

2023:PHHC:083669 CRM-M-11159-2023(O&M) complainant has also been withdrawn in view of compromise arrived between the parties vide order dated 24.01.2023 passed by learned JMIC, Sira. 3.

On a Court query, learned counsel appearing on behalf of respondent No.2 submits that complainant is not interested to press any charges against petitioner-accused.

Since matter has been compromised, no purpose would be served to continue proceedings arising out of FIR in question as same would be an exercise in futility and waste of precious time of the Court below. 5.

In the totality of circumstances, FIR No.455 dated 07.09.2022, registered under Section 174-A of IPC, at Police Station Sirsa Sadar, District Sirsa along with all consequential proceedings including impugned order dated 28.04.2022 (Annexure P-3) passed by learned Judicial Magistrate First Class, Sirsa declaring petitioner as proclaimed person in a criminal complaint No.NACT-10012020 dated 09.09.2020 titled as "Surjeet Singh Vs. Mannat Rani", under Section 138 of NI Act, are quashed.

Petition is allowed accordingly.
