**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.228 dated 13.07.2016, under Sections 498-A, 304-B and 120-B IPC and Sections 306, 34 IPC (substituted later on), registered at Police Station Pinjore, District Panchkula.
Learned counsel for the petitioner submits that the petitioner is in custody since 15.07.2016. This Court has already been granted the concession of anticipatory bail to parents-in-law and sister-in-law of the deceased, vide orders dated 14.02.2017 (Annexures P-5 and P-6). Moreover, from the suicide note it transpires that she was a chronic patient and was unable to conceive a child.
Learned State counsel, on instructions from the investigating officer, has informed that out of total 16 witnesses, only 2 have been Naresh Kumar 2017.05.24 15:59 I attest to the accuracy and integrity of this document Chandigarh examined.
CRM-M-14751-2017 -2I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. The petitioner was arrested on 15.07.2016. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Panchkula.
Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
