Mr. Harsh Aggarwal, Advocate for the appellant. **** Anupinder Singh Grewal, J. (Oral) The appellant has impugned the judgment of the Single Bench, whereby his writ petition challenging the award of the Labour Court has been dismissed.

Learned counsel for the appellant submits that the appellant had applied for voluntary retirement on the condition that he would be paid compensation equivalent to salary for a period of 106 days for each completed year of service, but the respondents did not make any payment. The respondents did not pay this amount and therefore, his request for voluntary retirement ought not to have been accepted.

The appellant, who was working as an Assistant is stated to have applied for voluntary retirement, which was accepted by the respondents. A perusal of the request of the appellant for voluntary retirement indicates that it was an application for voluntary retirement simpliciter without any pre-condition attached therewith. LPA-842-2025 (O&M) Court to indicate that his request for voluntary retirement was subject to any condition whatsoever. We are therefore, in agreement with the judgment of the Single Bench that the award of the Labour Court dismissing the claim of the appellant does not suffer from any illegality. Consequently, the Letters Patent Appeal being devoid of any merit stands dismissed. 5.
