**** JAGMOHAN BANSAL , J. (Oral) The petitioners through instant petition are seeking quashing of FIR No.70 dated 27.09.2018 registered at Police Station Dabua, District Faridabad, under Sections 498-A, 406, 34 IPC and charge-sheet dated 25.04.2019 whereby JMIC, Faridabad has framed charges against them. The impugned order i.e. order framing charges was passed on 25.04.2019 and the present petition has been filed after the expiry of almost 04 years.

On being confronted with this fact, learned counsel for the petitioners submits that the petitioners are resident of Bihar and it is very difficult for them to join proceedings at Faridabad, thus, their presence may be exempted. He further undertakes that if any adverse order is passed in their absence, they will not challenge the said order on the sole ground of their absence.

Without commenting on the merits of the case, the petition is disposed of with following directions :

i) Personal appearance of the petitioners before trial Court shall remain exempt;

iii) The petitioners shall not raise any grouse on the sole ground of their absence, if any adverse order is passed against them;

iv) The petitioners shall be at liberty to raise all the pleas before the trial Court and avail remedies as permissible by law, if any adverse order is passed against them.
