(ORAL) Prayer in the present petition filed under Section 482 Cr.P.C is for issuing direction to respondents No.2 and 3 to submit the status report in case FIR No.65 dated 23.02.2020, registered under Sections 420, 467, 468, 471 of the Indian Penal Code, at Police Station Sector 14, Gurugram. 2.

Status report dated 23.05.2023 by way of affidavit of Kapil Ahlawat, HPS, Assistant Commissioner of Police, Old Gurugram on behalf of respondents No.1 to 3 is filed by the learned State counsel in Court today and the same is taken on record, subject to all just exceptions, wherein para 5 of the status report reads as under:

That the said untrace report was filed in the Court of Ld. HIMANI GUPTA 2023.05.29 16:20 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh

2023:PHHC:076238 CRM-M-11820-2023 -2JMIC, Gurugram on 04.01.2022. The said untrace report has been accepted by the Ld. JMIC, Gurugram vide order dated 05.08.2022, with the liberty to re-open the case as and when the police gets any clue of the culprit(s) or any fresh material further comes forth. The copy of order dated 05.08.2022 is attached herewith as Annexure R-1 for kind perusal of this Hon'ble Court."

Learned counsel for the petitioner submits that the petitioner has already filed the protest petition before the Court below and prays that he may be permitted to withdraw the present petition with liberty to raise all the pleas available to him before the trial Court. 4.

In view of the submission made by learned counsel for the petitioner, present petition is dismissed as withdrawn with the liberty aforesaid.
