Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.115 dated 24.02.2018 under Section 506 IPC and Section 4 of POSCO Act, 2012, registered at Police Station Gharaunda, District Karnal.
It is contended that petitioner is incarcerated since February 26, 2018. Investigating agency has not yet submitted challan before the court. Petitioner is no longer required for the purpose of investigation. Statement of victim under Section 164 Cr.P.C. has been recorded. His medical examination has been conducted.
Learned counsel for the State has opposed the prayer for bail. Keeping in view aforesaid contentions, period of his incarceration and the fact that trial may take long time to conclude, no useful purpose would be served by detaining the petitioner any longer. Thus without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Karnal.
