**** HARSIMRAN SINGH SETHI , J. (ORAL) Counsel for the petitioner states that the petitioner was imposed a punishment of recovery, vide order dated 23.11.2009. Against the said order, petitioner had filed an appeal before the appellate authority. During the pendency of the appeal, respondents started the proceedings for the recovery of the said amount by initiating arbitration proceedings under Sections 55/56 of the Punjab Cooperative Societies Act, 1961.

Counsel for the petitioner further states that in those proceedings, the petitioner has been held liable to pay the said amount, which has been imposed by way of punishment.

Counsel for the petitioner further states that now after passing of the impugned order dated 18.09.2018, the appeal filed by the NARESH KUMAR 2019.03.11 16:34 I attest to the accuracy and integrity of this document Chandigarh

CWP-5798-2019 -2petitioner against the order imposing punishment has been decided and the punishment has been set aside, therefore, he prays that the petitioner be allowed to withdraw the present writ petition with a liberty to approach the respondents by filing review/appropriate proceedings in respect of the facts which have come into being after the impugned order was passed.
