The present appeal pertains to the year 1992. Vide order dated 17.01.2023 notice was ordered to be issued to the respondent and as noticed vide order dated 20.02.2023, notice was received back with the report that proprietor of the respondent-firm has since died and the case was adjourned to 12.04.2023 for taking steps to implead his legal representatives. On 12.04.2023 learned counsel for the appellant had sought more time to comply with the order dated 20.02.2023 and the case was adjourned to 10.07.2023. Thereafter the case was adjourned to 24.08.2023 and on that date last opportunity was granted to the counsel for the appellant to comply with the above order. Thereafter, as per the standing instructions, fresh notice was issued to the respondent and as noticed vide order dated 15.11.2023 the respondent-firm is reported to have been closed and learned counsel for the appellant sought time for taking necessary steps and the case AMAN JAIN 2024.05.17 21:39 I attest to the accuracy and integrity of this judgment/order.

RSA-336-1992 (O&M) -2was adjourned to 10.04.2024. On 10.04.2024 learned counsel for the appellant had again sought time to comply with the order dated 15.11.2023 and the matter was adjourned to today.

Today learned counsel for the appellant states that since the proprietor of respondent-firm has died and the firm itself has been closed, he has not been able to comply with the previous orders. Though Ms. Sunita Gupta, Advocate has put in appearance, she pleads no instructions. 3.

In view of the above and the fact that the appeal relates to the year 1992, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
