**** AMIT RAWAL, J. (ORAL) The appellant-defendant is in regular second appeal against the concurrent findings of fact, whereby the suit for recovery of `1,25,264.86 along with interest @ 12% per annum, had been decreed by the trial Court and upheld by the lower Appellate Court.

This Court while issuing notice of motion had ordered for depositing the decreetal amount within a period of three months from 19.06.1989, which was permitted to be withdrawn by the decree-holder after furnishing adequate security to the satisfaction of the Executing Court and the execution petition was stayed.

This Court on 11.01.2018 noticed that the initial stay granted by this Court has been vacated as the amount was not deposited.
