R.P. Nagrath, J. (Oral) Learned counsel for respondents no. 2 to 5 submits that in view of the decision of the courts below, which is under challenge in the instant revision, the petitioners have filed eviction petition No. 30/03.11.2009 against respondents no. 2 to 5 on the ground of nonpayment of rent and bonafide necessity, admitting them to be the tenants in view of the findings in the instant case. Learned counsel has also handed over certified copy of eviction petition instituted on 03.11.2009, which is pending before the Rent Controller and the same be taken on record.
In view of the above, learned counsel for the petitioners submits that instant petition would be rendered infructuous and the same may be disposed of as such.
Ordered accordingly.
In case, the statement made on behalf of respondents no. 2 to 5 is found to be incorrect, the petitioners would be at liberty to file application for restoration of the instant revision.
