ALKA SARIN, J. (ORAL) On 16.01.2023 the following order was passed : "It has been informed by Mr. H.R. Bhardwaj, Advocate that the counsel for the appellant has since expired. None has put in appearance on behalf of the respondent. Let notice of the appeal be issued to the parties, returnable 23.02.2023."

As per the office report, both the appellant and the respondent have since died. Today none has put in appearance on behalf of the parties nor the legal representatives have come forward to be impleaded as parties. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

Dismissed for non-prosecution.
