R.P. Nagrath, J. (Oral) Prayer in the instant petition is for grant of anticipatory bail under Section 438 Cr.P.C. in FIR No. 43 dated 16.03.2015 for offences under Sections 432, 323, 382, 427, 506, 354, 148 and 149 of Indian Penal Code (IPC), registered at Police Station Sadar, Amritsar.
Learned State counsel on instructions from HC Sandeep Singh submits that petitioners have joined investigation on 02.08.2015 but recovery of gold chain apart from some cash amount is yet to be recovered, but this contention is opposed by learned counsel for petitioners and it is submitted that the instant FIR is counter-blast to FIR registered by the co-accused against the complainant.
In view of the above and without commenting on merits of the case, the interim order dated 07.05.2015 is made absolute subject to petitioners again appearing before the Investigating/Arresting Officer on 13.08.2015 between 11.00 a.m. to 02.00 p.m. Petitioners are directed to abide by the conditions JITENDER KUMAR 2015.08.04 10:32 I attest to the accuracy and authenticity of this document Chandigarh
