***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.569 dated 29.12.2017 under Sections 148, 149, 302,323, 452 and 307 IPC, registered at Police Station Sonepat Sadar, District Sonepat.
It is contended that two injuries were found on the person of deceased i.e. one on the head in the parietal region and the another on the knee. Petitioner is a 63 years old lady. It is yet to be ascertained as to who caused the fatal injury. She is incarcerated since 31.12.2017. No prosecution witness has been examined till now. Keeping in view aforesaid contentions, period of her incarceration and the fact that trial may take long time to conclude, no useful purpose would be served by detaining the petitioner any longer. Thus without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Sonepat.
