The present petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.75 dated 01.08.2022, registered under Sections 21 and 22 of the NDPS Act at Police Station Sadar Banga, District SBS Nagar.

Learned State counsel has filed reply on behalf of the respondentState, which is taken on record, wherein para 7, it has been stated that all prosecution witnesses have been examined and now the case is pending for 09.08.2024 for the statement of the petitioner under Section 313 Cr.P.C. 3.

In view of the above, learned counsel for the petitioner does not press the present petition at this stage.
