Kashmir Singh v. Kirpal Singh
DAILY LOK ADALAT BENCH NO.3 RSA NO.408 OF 1992 KASHMIR SINGH V/S KIRPAL SINGH * * * *
Present:
Mr. Rajinder Singh Aulakh, Advocate For the appellant.
Mr. S.C. Chhabra, Advocate For the respondent.
* * * * Kirpal Singh, respondent, herein, filed a suit for the recovery of `10,000/- and in the alternative, for the return of the tractor. The Trial Court dismissed the suit, however, on appeal the learned Additional District Judge had reversed the judgment and decree of the Trial Court and decreed the suit for the recovery of `10,000/-. Hence, this appeal at the instance of the defendants. Appeal was admitted to a regular hearing and stay had been declined. Learned counsel representing the appellant states that he wrote a number of letters and tried to contact the appellant as well, but he got no response from him. Since no stay order was passed, decree must have been satisfied. In this view of the matter, this appeal is consigned to record with liberty to the appellant to get it revived in case of need. (G.C.
