(Oral) Report dated 30.5.2016 of learned Judicial Magistrate Ist Class, Malout has been received after recording statements of accused Mohinder Singh, Gurdarshan Singh and Sukhwinder Singh as well as complainant Gurmit Singh and the learned court has shown its satisfaction that the compromise is an outcome of voluntariness, free will and without any coercion or undue pressure.
In the light of the satisfaction shown by the Court and in view of the fact that compromise will go a long way in resolving the personal dispute and to bring about personal harmony and more-so the offences for which the accused have been booked are not of very serious nature and being version and cross-version case and in view of the law laid down in Gian Singh vs State of Punjab and another, 2012 (4) Dalbir Singh Tiwana 2016.09.05 10:56 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh.
Criminal Misc. No. M-15806 of 2016 -2RCR (Criminal) 543 and Kulwinder Singh and others vs State of Punjab and another, 2007(3) RCR (Criminal) 1052 and in view of which the prayer made in the petition is allowed, proceedings by way of DDR No. 11 dated 24.5.2009 under sections 326/324/34 IPC in FIR No. 60 dated 26.5.2009 registered at Police Station Sadar Malout, District Sri Muktsar Sahib under sections 326/325/324/323/148/149 IPC and all consequences arising thereof are quashed, qua the present petitioners. The petition stands allowed in those terms.
