R.P. Nagrath, J. (Oral) Prayer in the instant petition is made for grant of prearrest bail under Section 438 Cr.P.C. in FIR No. 118 dated 30.03.2015 for offences under Sections 323, 452, 382, 427, 506 and 149 of Indian Penal Code (IPC) registered at Police Station Basti Jodhewal, Ludhiana.

On asking of the Court, Mr. Gazi Mohd. DAG, Punjab accepts notice on behalf of the State and Ms. Jigyasa Tanwar, Advocate for the complainant.

Let requisite number of copies be supplied to learned State counsel and counsel for the complainant. The case of the petitioners is in pari materia with the prayer made by the co-accused in CRM-M-12611 of 2015 fixed for today. CRM-M-14834 of 2015 -22015, the instant petition is allowed and the petitioners are directed to appear before the Arresting/Investigating Officer on 15.05.2015 between 11.00 a.m. to 02.00 p.m. Petitioners are also directed to keep on joining the investigation as and when required and cooperate with the same. The petitioner shall also abide by the restrictions contained in Section 438 (2) Cr.P.C. Any recovery made in pursuance to the disclosure statement would be admissible under Section 27 of the Evidence Act. In case, petitioners fail to appear before the Arresting/Investigating Officer on the date stipulated above, the concession granted to them vide this order shall automatically stand vacated.
