ARUN MONGA, J.(ORAL) Learned counsel for appellants states that per his instructions obtained from legal heirs of appellants, during long interregnum of the appeal being admitted and now being taken up for final hearing, parties have already settled their dispute amicably.
No one has caused appearance on behalf of respondent. Being so, instant appeal stands disposed of as infructuous with liberty to respondent to revive the same in case no compromise has been arrived at between the parties.
Disposed of as infructuous.
Needless to say in view of appeal being disposed of as infructuous, decree passed by the Courts below in favour of respondent shall not be put to execution, as terms of compromise would prevail over the same.
