Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail on behalf of accusedGurdeep Singh @ Mahant Ganesh Dass in case FIR No.110 dated 25.9.2015 under Sections 419,465,468 IPC, PS Gidderbaha, Distt. Sri Muktsar Sahib. Allegations are that there was an effort on the part of accused party to sell property of a Dera situated in Mumbai for a sum of Rs.14.5 crores. An agreement to sell is alleged to have been executed based on fake documents and receipt of earnest money of Rs.10 lacs. It is contended that two other co-accused have been granted anticipatory bail. It is further contended that factually there can only be an attempt to cheat as no actual cheating has taken place qua the complainantDera. Learned counsel for the complainant points out that two coaccused Manjit Singh Mann and Ramesh Kumar were introducers of the present petitioner at the time of opening of an account being already RAJINDER PRASHAD JOSHI 2016.05.20 18:02 I attest to the accuracy and integrity of this document

CRM-M 15889/2016 account holders in the same bank and as such there being a doubt regarding their complicity in the offence, anticipatory bail has been granted. The petitioner cannot draw any sustenance from such relief granted to them. Learned State counsel on instructions submits that none of the 8 named accused have been arrested so far and investigations are at a standstill.

Without commenting on the merits of the case, keeping in view the nature and gravity of offence, no case for grant of anticipatory bail is made out as the custodial interrogation would be required for a fair and proper investigation.

Dismissed.
