Challenge in the present regular second appeal is to the concurrent findings of facts returned by Courts below in favour of the defendant-respondents in a suit filed for seeking permanent injunction. 2.

Mr. Ashutosh Hoshiarpuri, Advocate submits that since Mr. O.P. Hoshiarpuri, Advocate who had filed the present appeal, is no more, he has no instructions in the matter.

As per office report, sole appellant has died. 4.

There is no representation on behalf of the respondents as well. 5.

In view of the above, this Court has no option but to dismiss the present appeal for non-prosecution with liberty to revive the same, if need arises. 6.

Ordered accordingly.
