The petitioner was employee of Haryana State Federation of Consumer's Co-operative Whole Sale Stores Limited, Chandigarh (in short "CONFED"). He was holding post of General Manager. He alongwith many other employees was declared as surplus staff. As per Policy of State Government, he was absorbed in State Government. 2.
The petitioner claims that he should be granted benefit of pay protection. He had worked for quite some time with CONFED, thus, his last drawn pay should be protected.

Mr. Ganesh Kumar Sharma, Advocate submits that government has issued instructions dated 06.10.1998 whereby it has been clarified that surplus staff on absorption in government department shall not be entitled to PARAMJIT KAUR SAINI 2025.02.28 02:46 I attest to the accuracy and integrity of this document
CWP No. 5172 of 2000 (O&M) -2benefit of past service except pay protection. The respondent has already granted pay protection to similarly situated employees. 4.
Faced with circular dated 06.10.1998, Ms. Rajni Gupta, Addl. A.G., Haryana submits that competent authority would consider claim of the petitioner in the light of aforesaid letter as well as status of similarly situated employees.

In the wake of statement of learned State counsel, the petition stands disposed. Let the needful be done within six months from today. The petitioner shall be entitled to arrears, if any found due, without interest. 6.
