(ORAL) Appellant herein is plaintiff seeking to set aside impugned judgment/ decree dated 15.10.1991 whereby appeal filed by respondents-defendants against judgment/ order dated 12.04.1989 decreeing suit of plaintiff for recovery of Rs.16,214-62 with costs and future interest at the rate of 12% P.A. from the date of decretal amount, was allowed and judgment/ decree dated 12.04.1989 was set aside.

Matter was taken up for hearing on 16.03.2023 when being an old matter, learned counsel for appellants had sought time to seek instructions. Meanwhile, since respondents No.2, 3, 5 and 6 had died, it was also required on the part of appellants to implead their LRs. Steps were also to be taken to serve unserved respondents. When matter taken up today, neither anyone appears on behalf of appellants nor has any steps taken as aforesaid. It seems that appellants either not interested to prosecute the appeal by sheer passage of time. 3.

Be that as it may, dismissed in default.
