IN THE HIGH COURT OF PUNJAB & HARYANA, CHANDIGARH

Sr. No.: 112 Civil Writ Petition No.4756 of 2024 Date of Decision: March 07, 2024 Manoj Kumar ..... PETITIONER(S)

VERSUS

State of Haryana & others ..... RESPONDENT(S) . . .

CORAM:

HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA . . .

PRESENT: - Mr. Mazlish Khan, Advocate, for the petitioner. Mr. Sanjeev Kaushik, Additional Advocate General, Haryana.

. . .

Tribhuvan Dahiya, J (Oral) The petition has been filed seeking a writ of certiorari quashing the impugned order dated 22.02.2024, Annexure P-14, whereby the petitioner has been transferred from Government College, Jind, to Government Girls College, Pillukhera, Jind, in order to adjust respondent No.4.

2.

This Court is not inclined to interfere with the order of transfer which appears to have been passed on administrative grounds. Learned counsel for the petitioner has expressed apprehension that the petitioner's service might be dispensed with since he has been posted against workload, and not sanctioned post.

3.

It is apparent on record that the petitioner had earlier approached this Court by filing Civil Writ Petition No.22233 of 2021, wherein AVIN KUMAR 2024.03.07 17:23 I attest to the accuracy and integrity of this judgment/order.

2024:PHHC:032862 CWP No.4756 of 2024 [2] vide the interim order dated 02.11.2021, Annexure P-7, it was directed that he shall not be replaced by another contractual employee, subject to his work and conduct being satisfactory. It is submitted that the interim order is in operation, and the petition has not been finally decided. 4.

In view thereof, there is no apprehension of the petitioner's service being dispensed with on account of the impugned transfer order dated 20.02.2024. Therefore, there is no ground to entertain the petition at this stage. 5.
