G.S.SANDHAWALIA, J. (Oral) The petitioner seeks relief of adjustment against the free vacant seats of four years' Bachelor of Engineering Course (Electrical) in the respondent-college and for direction to refund the amount paid by the petitioner against the paid seat.

The stand of respondent no. 3-college is that admissions were made in the year 2001 under the common entrance test conducted by respondent no. 1-university. The petitioner had a low rank and was granted admission on 23.09.2001 as no free seat was available in the respondentcollege and accordingly, he was allowed the electrical engineering branch. He was never forced to take admission in the respondent-college and he took admission on his own as per his merit. It is further submitted that two more candidates higher in rank than the petitioner were studying in the respondent-college and the petitioner is not entitled to get admission in the SHIVANI GUPTA 2016.08.04 12:57 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 19735 of 2002 free seat even if it was available. Even perusal of the writ petition would go on to show that the petitioner has taken admission on account of nonavailability of free seat when his turn came. A period of more than 14 years has expired since then. The petitioner would have passed out of the institute by now and the question of adjusting does not arise. None has put in appearance on behalf of the petitioner. It is apparent that the matter has been rendered infructuous by the sheer efflux of time and is accordingly disposed of as such.
