******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 13 dated 30.01.2015 registered for offences punishable under Sections 379 of Indian Penal Code (IPC) and 21 of the Mines and Minerals Regulations Development Act, 1957, at Police Station Sidhwan Bet, District Ludhiana Rural.
Heard.
Learned State counsel submits that the petitioner has surrendered before the Court on 24.04.2018. The investigation is still in progress and custodial interrogation of the petitioner is not required. Without expressing any opinion on the merits of the case, this petition is allowed and order dated 19.04.2018 is made absolute, subject to the following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

CRM-M-15937 of 2018 -2- (b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
