******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.126 dated 27.12.2017 registered for offences punishable under Sections 323/324/379-B/148/149 of Indian Penal Code, at Police Station Ghuman, District Batala. (Offence punishable under Section 326 IPC was added later on).

Heard.

As per case of prosecution, petitioner had caused injury on head of complainant-Dhyan Singh with kulhari, which was a injury with sharp edged weapon and was declared grievous in nature after C.T. scan. Learned counsel for the petitioner submits that it is a crossversion case. Injuries were also caused to brother of petitioner and DDR (Annexure P-2) was registered in this regard. There is long standing enmity between the parties. Earlier also injuries were caused to petitioner and FIR was registered against complainant party in which they are facing trial. CRM-M-15950 of 2018 -2Learned State counsel submits that cross-version case has been investigated by the police and the same was found to be false. Keeping in view the nature of injury, which was caused with sharp edged weapon i.e. Kulhari and that it was on vital part of the body, I do not find any reason to exercise discretionary power of this Court to extend the benefit of anticipatory bail to petitioner. This petition has no merit and the same is dismissed.
