The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.39 dated 28.5.2014 registered for the offences under Sections 22 and 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station Noormahal, District Jalandhar. Notice of motion has been issued in this case. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner and learned Assistant Advocate General, Punjab appearing for the respondent-State and have gone through the record.
As per the case of the petitioner, he was on regular bail before Harpal Singh Parmar 2017.05.23 16:24 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-15090 of 2017 [2] the trial Court, but he absented from the proceedings on 11.3.2017. Learned counsel for the petitioner also stated that the petitioner was granted bail under Section 167(2) Cr.P.C. and now he has come to seek anticipatory bail for the other offences in the FIR also. Keeping in view the facts and circumstances of the present case and the fact that the petitioner was already on regular bail as argued and has absented only on one date i.e. on 11.3.2017, therefore, no useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the present case; I find merit in this petition and the same is allowed. The interim order dated 2.5.2017 passed by this Court granting interim bail to the petitioner is made absolute. If the petitioner appears before the trial Court within ten days from today, the trial Court will release him on bail including the other offences, if any, in this FIR subject to its satisfaction. May 22, 2017.
