This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 116 dated 17.09.2014 under Sections 420 & 406 IPC at Police Station B.S. Barnala.
Learned counsel for the petitioner contends that petitioner is in custody since February 16, 2015 and case is triable by Magistrate. Thus, no useful purpose would be served by detaining the petitioner in custody any longer. Learned State counsel has opposed the prayer for bail on the ground that allegations against the petitioner are serious. I have heard learned counsel for the parties. Case is triable by Magistrate. Investigation has been completed and case is at the stage of consideration of charge. Keeping in view the facts and circumstances of the case particularly that investigation has been completed and it is a magisterial trial, I am of the considered view that that no useful AJAY KUMAR 2015.05.19 16:23 I attest to the accuracy and authenticity of this document
CRM-M 15047 of 2015 purpose would be served by detaining him in custody any longer. Without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner. Accordingly, petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Barnala.
