On 18.2.2026, the following order was passed: 'Prayer in the present petition, filed under Section 482 of the BNSS, 2023, is for grant of anticipatory bail to the petitioner in a case FIR No.174 dated 03.09.2025, registered under Sections 249, 249B, 253, 253B of the BNS, 2023 and Sections 25 & 27 of the Arms Act, 1959, at Police Station Civil Lines, Patiala, District Patiala.
Learned counsel for the petitioner submits that the petitioner has been falsely and frivolously implicated in the present FIR case. He submits that the petitioner is a resident of Patiala whereas, he has been alleged to have harboured accused-Harmeet Singh of Pathanmajra, who is facing prosecution in FIR No.173 dated 01.09.2025, registered under Sections 376, 420 and 506 of IPC. He further submits that co-accused of the petitioner, namely, Amardeep Singh has already been granted anticipatory bail by this Court vide order dated 27.10.2025 passed in CRM-M-522232025 and claims parity. It is submitted that as no prima facie case is made out against the petitioner, thus, he deserves concession of anticipatory bail.
CRM-M No.9322 of 2026 -2Notice of motion. Mr. Ramta Chowdhary, DAG, Punjab, accepts notice on behalf of the respondent-State and prays for time to have instructions. Now to come up for further consideration on 01.04.2026. In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to the satisfaction of the Arresting Officer/ Investigating Officer. The petitioner shall join investigation before the Investigating Agency/Officer. He shall abide by the following conditions as envisaged under Section 482(2) of the BNSS, 2023 (erstwhile Section 438(2) of Cr.P.C.):- (i) That the petitioner shall make himself available for interrogation by a police officer as and when required to do so.
(ii) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer.
(iii) That the petitioner shall not leave India without prior permission of the Court.'

Learned State counsel (on instructions) submits that pursuant to the order dated 18.2.2026, the petitioner has joined investigation and is no longer required for custodial interrogation.

In view of the above, the instant petition is allowed. Interim order dated 18.2.2026, passed by this Court is made absolute, subject to the conditions as enumerated under Section 482(2) of BNSS. 4.
This order should not be treated as "blanket" order. It will not be read granting petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 5.
Liberty is reserved in favour of State/complainant to move for
CRM-M No.9322 of 2026 -3cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 482(2) of BNSS or upon showing any other sufficient cause.
