Maghar Singh v. State Of Punjab & ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CRM-M 15053 of 2015 Date of decision : 08.05.2015 Maghar Singh ....Petitioner V/s Tate of Punjab & ors.
....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. L.S. Sidhu, Advocate for the petitioner.
RAJAN GUPTA J.
Petitioner has sought a direction to the official respondents to initiate criminal proceedings against respondent no. 6 for having misappropriated amount of `7,74,500/- from the account of Khalsa High School, Mansa.
Learned counsel has referred to orders passed in various writ petitions to contend that petitioner has misappropriated amount of `7,74,500/- which was the lease money. However, no action had been initiated by the official respondents in the matter. Heard.
I am of the considered view that petition preferred by the petitioner is misconceived. In the eventuality matter was considered by this court in another case it was open to it to direct action against respondent no. 6. It, however, appears that petitioner has invoked inherent jurisdiction of this court to settle personal scores with respondent no. 6 against whom he has been litigating. Petition is, thus, without any merit and is dismissed. It is made clear that in case any fresh petition is filed by the petitioner containing frivolous prayer similar in nature to the instant one, this court shall consider imposition of exemplary costs.
