2. Whether the judgement should be reported in Digest ? RAMESHWAR SINGH MALIK, J Petitioner seeks pre-arrest bail in criminal complaint no.53 of 2012 titled as Shinda Singh Vs. Manga and another, under Sections 323/379/506 IPC and under Section 3(x) of SC/ST Act,1989. Learned counsel for the petitioner submits that the petitioner is not running away from his liability. He is ready to surrender before the trial court. However, he seeks interim protection for the said purpose. Learned counsel for the petitioner submits that the story put-forth in the complaint is a concocted one on the face of it. There was no occasion for the petitioner to indulge in such an activity. Complainant initially approached the police and the matter was found to be without any substance. No cognizable offence was found to be made out. This was the specific reason that no FIR was registered. Crl.Misc. No.M-15067 of 2015 implicate the petitioner, this complaint was filed by the complainant. Having heard learned counsel for the petitioner and without expressing any opinion on the merits of the case, lest it should prejudice the rights of either of the parties, petitioner is directed to appear before the learned trial court on 21.5.2015. On appearance of the petitioner, his application for bail shall be considered sympathetically, keeping in view the totality of facts and circumstances of the case, to be brought to the notice of the learned trial court. Till the bail application of the petitioner is considered and decided, petitioner shall be entitled to interim protection, however, to the satisfaction of the leaned trial court.

With the above said observations made and directions issued, the present petition stands disposed of.
