(ORAL) The present petition has been filed under Articles 226/227of the Constitution of India inter alia seeking issuance of a writ in the nature of Mandamus for directing respondent No.3 to decide the stay application dated 18.12.2024 under Section 408 B (2) of the Haryana Municipal Corporation Act, 1994 (hereinafter referred as the Act), filed by the petitioners along with appeal dated 18.12.2024 under Section 408 B (1) of the Act (Annexure P-14) in a time bound manner.

Mr. Nischal Manchanda, Advocate appears on behalf of respondents No.3 and 4, pursuant to the advance copy of petition having been sent to the Municipal Corporation and informs the Court that the appeal filed by the petitioner under Section 408 B (1) of the Haryana Municipal HIMANI GUPTA 2025.05.22 09:35 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh Corporation Act, 1994 already stands withdrawn by the petitioner on

CWP-4817-2025 (O&M) -205.05.2025, accordingly, the instant petition has been rendered infructuous. 3.

Keeping in view the aforesaid submissions made by respondents No.3 and 4, the present petition is dismissed as having been rendered infructuous, however, in case the statement made by respondents No.3 and 4 is not correct, the petitioner shall be at liberty to seek revival of the instant writ petition.
