HARSH BUNGER, J. (ORAL) Prayer in the present petition, filed under Section 482 of the Code of Criminal Procedure, is for issuance of direction to respondent Nos.2 to 4, to conduct fair and proper investigation in case FIR No.15 dated 13.01.2023 registered under Sections 324 and 323 read with Section 34 of the Indian Penal Code, at Police Station Gidderbaha, District Sri Muktsar Sahib and also to add offence under Section 376 of the Indian Penal Code, in the above said FIR.

Pursuant to the advance copy of petition having been sent to learned State counsel and also in compliance of order dated 16.03.2023 passed by this Court, status report on behalf of respondents No.1 to 4 by way of an affidavit of Sh. Jasbir Singh, PPS, Deputy Superintendent of Police, Sub Division Gidderbaha, District Sri Muktsar Sahib, has been filed, which is already on record.

Learned State counsel while referring to status report submits that it is a case of version and cross-version and that the investigation of the case is being conducted by the competent police officers in a free and fair manner.

Learned counsel for the petitioner, in view of the reply filed by the learned State counsel, submits that he may be permitted to withdraw the present petition with liberty to take all pleas, at the relevant time, before the trial Court.
