MANJARI NEHRU KAUL, J. (Oral) This is second petition under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No. 267 dated 27.11.2019 registered under Section 21 (Act 61 of NDPS Act, 1985) and later on added Sections 25/54/59 of Arms Act, 1959 and Section 29 (Act No.61 of 1985) vide Rapat No.9 dated 30.11.2019 at Police Station City Moga, District Moga. Learned counsel submits that the petitioner has been falsely implicated in the case in hand on the basis of disclosure statement of the main accused from whom recovery of 4 kg. 10 grams of heroin was effected. Learned counsel submits that no recovery was effected from the petitioner.

Per contra the learned State counsel has opposed the prayer and has submitted that the petitioner is a man of criminal antecedents RUPINDER KAUR 2021.03.25 15:47 I attest to the accuracy and integrity of this document

CRM-M-12431-2021 (O&M) [ 2 ] inasmuch as he was already involved in another case under the NDPS Act and this FIR was registered thereafter. Learned counsel has further submitted that not only was the recovery of contraband huge and fell under the category of 'commercial quantity' but the co-accused had been apprehended with arms and ammunition from the Indo-Pak Border. Learned counsel submits that in fact the petitioner is the master mind for which he does not deserve the concession of bail.

In the circumstances, no ground for grant of bail to the petitioner is made out.

The petition is dismissed.
