The petitioner is alleged to have inflicted a gandasi blow on the head of Harvinder Singh deceased. He seeks the concession of bail inter alia on the ground that he has been in custody w.e.f. 22.6.2013. The period of detention is a matter of concern while considering the petition for bail but the learned State counsel informs that all the prosecution witnesses qua the petitioner have been examined and the case is at penultimate stage and likely to be concluded soon.
Counsel for the petitioner, at this stage, informs that an application u/s 319 Cr.P.C. has been allowed by this court giving an option to the trial court to separate the trial by continuing the proceedings qua the petitioner. Counsel for the parties are not aware of the status of the trial whether it has been separated qua the different set of accused after the order passed by this court.
Since all the prosecution witnesses qua the petitioner stand already examined, I do not find any ground to grant him the concession of bail.
Dismissed. In case the trial is protracted on account of subsequent development on addition of accused, it will be open to the petitioner to approach this court gain.
