This petition has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in case FIR No.29 dated 4.5.2011 registered for the offences under Sections 379, 447, 427, 148 and 149 IPC at Police Station Bareta, District Mansa.

Notice of motion has been issued in this case. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned Assistant Advocate General, Punjab appearing for the respondentState and have gone through the record. Harpal Singh Parmar 2017.05.12 11:55 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-15164 of 2017 [2] From the record, I find that FIR in the present case has been registered in the year 2011 qua the occurrence which took place in 2009. The present petitioner was earlier stated to have been declared as innocent. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find that no useful purpose will be served by sending the petitioner to custody. Therefore, I accept this criminal miscellaneous petition and in the event of arrest, the petitioner shall be admitted to bail on his furnishing personal bonds and surety to the satisfaction of the Arresting/Investigating Officer. The petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
