(ORAL) Limited prayer made by learned counsel for the petitioner in this petition filed under Article 227 of the Constitution of India is to issue appropriate direction to the learned Executing Court to dispose of the execution petition bearing CIS No. EXE/153/2023 expeditiously in time bound manner as the petitioner is suffering from Stage - 3 oral cancer. 2.

Learned counsel for the petitioner contends that suit for recovery of Rs.1 crore along with interest was decreed in favour of the petitioner on 18.04.2019. The earlier execution petition filed in 2019 was withdrawn on 01.12.2022. Fresh execution was filed on 18.04.2023. As per the various zimni orders placed on record, learned counsel points out that appearance for Judgment Debtor No.2 was made on 04.08.2023 and on behalf of all the judgment debtor on 23.08.2024. Subsequent zimni orders reveal that many opportunities have been availed by the Judgment Debtors but till date they have not filed any objections. It is contended that Executing Court is unnecessarily NISHA 2025.03.12 15:16 I attest to the accuracy and integrity of this document

CR-1490-2025 -2-  adjourning the matter simply on the request of Judgment Debtors without taking effective steps.

Without issuing any notice to the Judgment Debtors, this Court disposes of the present petition with a direction to the concerned Executing Court to take effective steps for expeditious disposal of the execution petition by giving short dates and by avoiding unnecessary adjournments if sought by the Judgment Debtors.
