***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.38 dated 15.02.2018 under Sections 15/61/85 of NDPS Act, registered at Police Station Patran, District Patiala.

Learned counsel submits that petitioner is incarcerated since 15.02.2018. Admittedly, recovery effected from the petitioner is 52 Kg of poppy husk, which is marginally higher than commercial quantity. Learned State counsel has opposed the prayer for bail. Heard.

Keeping in view aforesaid contentions, period of his incarceration and the fact that trial may still take some time to conclude, no useful purpose would be served by detaining the petitioner any longer. Thus without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Patiala.
