This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.169 dated 25.3.2016 registered for the offences under Sections 148, 149, 323, 427, 506 and 307 IPC and Section 25 of the Arms Act at Police Station Sadar Palwal, District Palwal. Notice of motion to Advocate General, Haryana. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

Cr. Misc. No.M-15236 of 2017 [2] As per the FIR, the present petitioner is stated to have fired shot from the country made pistol at the brother of the complainant, namely, Mahabir with an intention to kill him, but he narrowly escaped. As per the learned State counsel none of the injuries has been declared dangerous to life. The present petitioner has been in judicial custody since 16.5.2016. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.

Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
