In this writ petition, Kurukshetra University assails the correctness of the Labour Court's award passed on 31.12.2018 directing the workman's reinstatement with continuity of service and full back wages. The workman's counsel prays that the award dated 31.12.2018 be set aside in view of the judgment passed by the learned Single Judge in Kurukshetra University and Another v. Madan Lal and Another (Civil Writ Petition No. 6544 of 2016, allowed on 21.08.2017). The petitioners' counsel has no objection thereto.

Keeping in view the consensus arrived at between the learned counsel representing the parties, the present writ petition is allowed and the Labour Court's award passed in Reference No. 257/2017 decided on DEEPAK KUMAR BHARDWAJ 2024.09.20 10:36 I attest to the accuracy and integrity of this document

Civil Writ Petition No. 5794 of 2019 31.12.2018, is set aside with liberty to the workman to seek reference under Section 10 of the Industrial Disputes Act, 1947. If the workman applies for reference, the appropriate authority will expedite its disposal. If the matter is referred to the Court, then efforts should be made to expedite its disposal.
