In view of the above, let notice be issued to the appellant returnable 23.01.2023."

As per the office report, the appellant is stated to have died. None has come forward to be impleaded as legal representatives of the appellant. The earlier counsel has also pleaded no instructions. In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution. Dismissed for non-prosecution.
