The prayer in the present Civil Writ Petition filed under Articles 226/227 of the Constitution of India, is to issue a writ in the nature of mandamus, for directing the respondents to release the payment of revised gratuity, residual payment in respect of missing credits for the months of 2/83, 3/83 and 4/87, leave salary for 9/90, arrears of lecturer grade with effect from 01.11.1966 to 31.12.1968, arrears of pay for the period with effect from 01.05.1971 to 31.07.1971 on account of Efficiency Bar duty period etc., arrears of pay on account of Efficiency Bar for the period from 01.08.1973 to 30.06.1974, arrears on account of grade revision for the period from 08.02.1978 to 29.02.1980, arrears on account of compulsory deposit scheme/new account not accounted for in General Provident Fund alongwith interest @ 18 % per annum.

Learned State counsel makes reference to para 1 of the preliminary submissions, which reads thus:- "1) That the main demand of the petitioner is to pay him all the outstanding dues. The following dues are demanded by the petitioner:- HAMANT 2024.03.13 18:54 I attest to the accuracy and integrity of this order/judgment

CWP-3909-1998 2024:PHHC:035505 a) Arrear of pay on getting between grade from 19.11.1967 to 31.12.1968 (31.12.1968) related to Govt. High School, Panjwar (District Amritsar) amounting to Rs.713/-.

b) Arrear relating to joining time from 1.5.1971 to 31.7.1971 of Govt. Hr. Sec. School, Jalandhar amounting Rs.966-50. c) Arrear on account of Grade revision relates to Govt. Sr. Sec. School, Dera Baba Nanak (District Gurdaspur), from 8.2.1978 to 29.2.1978, amounting Rs.128-55 and Rs.154-00. d) Arrears on account of Efficiency Bar relating to Govt.Sr.Sec. School, Dera Baba Nanak (Distt. Gurdaspur) from the month of 8/73 to 6/74, amounting Rs.1546-70.

The total amount as demanded by petitioner is equal to Rs.350880.It is submitted that the total amount has been paid to the petitioner vide this office cheque no. 0699438 dt.2.7.99.This cheque was presented in this Hon'ble Court on 7.7.99. It is submitted that an amount the of Rs.8829/-is still pending against the petitioner which was drawn by petitioner from treasury on account of BHRA by misusing his DDO Powers and by acting against the established rules and instrucions of Govt.of Ph.It is therefore, submitted that Hon'ble court may pass suitable order directing petitioner to deposit the excess amount over drawn by him while misusing his DDO powers."
